Your privacy matters. This policy explains what data OrderDash collects, why we collect it, and how we keep it safe. Plain language, no buried clauses.

§ 01 Information We Collect

We collect and process personal data depending on whether you use the Platform as a Customer or a Restaurant Partner:

  • Customer Data: We collect check-in names, order history, table details, session tokens, IP address, device ID, and optional email addresses for digital invoice delivery.
  • Restaurant Partner Data: We collect venue business name, venue category type, street address, owner's full name, business email, contact phone numbers, FSSAI registration details, PAN details, bank account details for settlement routing, and system configurations.

§ 02 Why Data Is Collected

We use the collected information for the following operational purposes:

  • To compile and process active customer orders and transmit them to the kitchen display consoles.
  • To facilitate split-billing payment transactions between diners and Restaurants.
  • To authenticate administrative access, POS waiter consoles, and partner dashboards.
  • To route payment settlements directly to the Restaurant's designated bank accounts.
  • To deliver customer support, perform server analytics, and prevent platform abuse.

§ 03 Payment Information Handling

OrderDash does not store, process, or transmit sensitive credit card details, CVV numbers, UPI PINs, or net banking passwords. All payment transactions are processed securely by our third-party payment gateway provider, Razorpay. Razorpay handles payment details in compliance with standard industry security practices (PCI-DSS).

§ 04 Data Sharing & Disclosure

OrderDash does not sell, trade, or rent personal identifiers or customer usage logs to advertising companies. We share information only under the following conditions:

  • With Restaurants: Customer check-in names and order lists are shared with the Restaurant and floor staff to facilitate preparation and billing.
  • With Payment Gateways: Transaction amounts, diner names, and invoice identifiers are shared with processors (Razorpay) to verify payment success.
  • Legal Requirements: We may disclose data if required by law enforcement, judicial orders, or to protect the safety, rights, and security of the Platform.

§ 05 Cookies & Local Storage

We use browser local storage (LocalStorage) on customer devices to maintain active cart items, check-in names, and running tab sessions, allowing diners to navigate the menu without losing their orders. We use session cookies on administrative devices to verify login state. You may disable cookies in your browser settings, though doing so will disable key ordering functionalities.

§ 06 Data Security Measures

We implement appropriate technical security measures, including HTTPS/SSL cryptographic transit layers, secure server hosting environments, password hashing, and Row-Level Security (RLS) filters on database queries to prevent unauthorized data exposure or leaks.

§ 07 Data Retention & Purge Policy

Customer check-in sessions, table carts, and transaction tokens automatically expire and are purged from active tables after 30 minutes of table inactivity. Deactivated venue profiles that remain inactive for more than thirty (30) calendar days due to subscription expiration will have their entire data trace—including credentials, menu databases, and transactional metrics—permanently and irreversibly deleted from our servers.

§ 08 User Rights

Users and Restaurant Partners have the right to inspect, correct, or request the deletion of their personal information where legally permissible. To request data deletion, please contact us at support@orderdash.in. Note that transactional records required for tax reporting or regulatory compliance cannot be deleted.

Clear rules on subscriptions, cancellations, and refunds — for both restaurant partners and diners. No surprises.

§ 01 SaaS Subscription Terms (For Restaurant Partners)

OrderDash provides software access to Restaurant Partners on a prepaid, subscription basis. All subscription payments, including monthly and yearly cycles plus 18% GST, are strictly final, non-refundable, and non-pro-rated. If you cancel or deactivate your plan mid-cycle, we will not issue a refund or store credit for the unused days. The subscription will remain active until the end of its prepaid period, after which the account will be deactivated.

§ 02 Diner Order Cancellation Limits

For customers placing orders at participating Restaurants through the Platform:

  • Before Order Acceptance: A customer may request order cancellation only if the Restaurant has not yet accepted or started preparing the order. If the Restaurant approves the request, the order is cancelled.
  • After Order Acceptance: Once the Restaurant accepts and begins preparing the order, the order is final and cannot be cancelled or refunded. This is necessary to avoid wastage of ingredients and labor by Restaurant kitchens.

§ 03 Valid Customer Refund Scenarios

Diners may be eligible for transaction refunds only under the following specific circumstances, subject to review and confirmation by the Restaurant:

  • Restaurant Closed: An order was placed but the Restaurant establishment was closed and unable to fulfill the request.
  • Item Unavailable: An item was paid for but is sold out, and the Restaurant cannot prepare it or offer a suitable alternative.
  • Duplicate Payment: A technical glitch resulted in multiple successful debits for a single checkout intent.
  • Technical Issue: A system error prevented order transmission to the kitchen, and the Restaurant was unable to process the order manually.

§ 04 OrderDash Non-Liability for Diner Refunds

OrderDash does not handle diner refund payments, and is not responsible or liable for any transaction refunds. The Restaurant Partner is solely responsible for verifying disputes and processing refunds to customers. All payments are received directly by the Restaurant via third-party gateways. Consequently, OrderDash does not hold transaction funds and cannot issue refunds. Diners must resolve all billing disputes, quality complaints, or refund claims directly with the Restaurant establishment.

§ 05 Dispute Resolution

If a customer is unable to reach a resolution with a Restaurant regarding a refund request, they may contact support@orderdash.in. OrderDash will act in good faith to share transaction logs and facilitate communication between both parties. However, the final refund decision resides solely with the Restaurant.

§ 01 Purpose & Intermediary Role

This Restaurant Partner Agreement (the "Agreement") is entered into between OrderDash (the "Company", "we", "us", or "our") and the participating dining establishment, restaurant, cafe, bar, QSR, or venue partner (each, a "Partner" or "Restaurant"). OrderDash is a technology platform that provides Software-as-a-Service (SaaS) licensing to Restaurants, enabling QR-code based menu browsing, customer ordering, Point of Sale (POS) tools, and Kitchen Display System (KDS) infrastructure. OrderDash acts strictly as a technology intermediary facilitating digital interface creation and UPI/payment collections on behalf of the Restaurant. Food preparation, packaging, quality, hygiene, pricing, guest service, and legal/regulatory compliance remain the exclusive and absolute responsibility of the Restaurant.

§ 02 Regulatory & FSSAI Compliance

The Restaurant warrants and represents that it possesses all required local business registrations, municipal permissions, health certificates, and food safety licenses, including an active and valid license issued by the Food Safety and Standards Authority of India (FSSAI) or equivalent regulatory body in the operating jurisdiction. The Restaurant agrees to maintain these licenses in active standing at all times while utilizing the Platform. The Restaurant shall compile and display its valid FSSAI registration number or license details on its physical premises and menu pages as required under applicable regulations.

§ 03 Menu Accuracy, Pricing & Allergen Information

The Restaurant holds sole, ultimate responsibility for all content uploaded to its online storefront, including menu descriptions, item imagery, pricing, and dietary classification tags (e.g., vegetarian, non-vegetarian, gluten-free, allergen disclosures). The Restaurant must ensure that menu descriptions are accurate, not misleading, and comply with all consumer protection laws. If guests make allergen inquiries, the Restaurant must address them directly. OrderDash disclaims all liability for food safety incidents, allergen mislabeling, or pricing discrepancies on the customer menu interface.

§ 04 Order Fulfillment & Dining Management

The Restaurant agrees to act in good faith to accept, prepare, and fulfill all customer orders routed through the Platform. The Restaurant is responsible for managing table availability, setting preparation limits, and notifying customers of unexpected preparation delays. OrderDash does not participate in kitchen operations or table service and is not liable for service delays, table booking conflicts, or customer dissatisfaction.

§ 05 Subscription Fees, Taxes & 18% GST

The Restaurant agrees to purchase and maintain a prepaid subscription plan (Basic, Pro, or Elite) to access the Platform. All listed subscription rates (e.g., ₹999/month, ₹2,499/month, or ₹4,999/month) are strictly exclusive of government taxes. A standard 18% Goods and Services Tax (GST) will be calculated and added to the base subscription fee at checkout. Subscription charges must be paid in advance of the service term. If a subscription is not renewed by its expiration date, access to the POS, KDS, and customer QR ordering menu will be suspended immediately. Profiles remaining inactive for more than thirty (30) days are subject to permanent database deletion.

§ 06 Payment Settlements & Transaction Flow

All diner payments settled via the digital QR checkout system are routed directly to the Restaurant's designated bank account via integrated third-party payment gateways (such as Razorpay Route or UPI networks). The Restaurant acknowledges that OrderDash does not handle, store, or hold customer funds in its own bank accounts. Consequently, any transaction delays, gateway failure events, payout calculation issues, or settlement errors are the responsibility of the payment gateway provider. The Restaurant must set up and maintain a valid merchant account with the payment processor to receive payouts.

§ 07 Refund Responsibility & Chargeback Liability

OrderDash does not handle customer refund payouts and is not responsible for any refund disputes. The Restaurant is exclusively and fully liable for all customer refund requests arising from missing items, incorrect orders, late preparation, cold or poor quality food, hygiene issues, or customer dissatisfaction. If a customer initiates a transaction chargeback, dispute, or credit card reversal through their card issuer or UPI bank, the Restaurant shall bear the full financial burden, including any chargeback assessment fees, dispute penalties, and the transaction value. The Restaurant agrees to hold OrderDash harmless from any diner refund or chargeback claims.

§ 08 Independent Tax Compliance & Disclaimers

The Restaurant is solely responsible for determining, configuring, and charging the correct tax percentage (including standard GST, state tax, and municipal levies) on diner bills. OrderDash provides an administrative "Global Tax (%)" input field purely as a logical software utility. OrderDash does not verify tax configurations, file tax returns, or collect tax amounts on behalf of the Restaurant. The Restaurant must review and modify its tax settings to align with local tax regulations, and agrees that OrderDash is not liable for wrong tax configurations, missing tax declarations, tax evasion, or incorrect tax charging by the Restaurant.

§ 09 Account Suspension & Platform Safeguards

OrderDash reserves the right to immediately suspend, restrict, or terminate the Restaurant's account and platform access without notice or liability if: (i) the Restaurant commits subscription payment default; (ii) the Restaurant violates FSSAI, tax, or local business guidelines; (iii) the Restaurant engages in fraudulent activities, such as creating fake orders, simulating false payments, or abusing customer data; or (iv) the Restaurant acts in an abusive, harassing, or deceptive manner toward diners or OrderDash staff.

§ 10 Broad Indemnification Clause

The Restaurant agrees to indemnify, defend, and hold harmless OrderDash, its parent company, affiliates, officers, directors, employees, and agents from and against any and all claims, lawsuits, administrative actions, losses, damages, liabilities, fines, penalties, interest, and costs (including reasonable attorney's fees) arising out of or relating to: (i) food safety incidents, food poisoning, hygiene violations, or customer illnesses; (ii) customer refunds, split-bill disputes, UPI failure events, or chargebacks; (iii) incorrect tax settings, failure to declare GST, or regulatory tax audit disputes; (iv) FSSAI or local licensing violations; or (v) the Restaurant's breach of any term in this Agreement.

§ 11 Limitation of Liability

IN NO EVENT SHALL ORDERDASH BE LIABLE TO THE RESTAURANT FOR ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR INDIRECT, SPECIAL, COVER, OR CONSEQUENTIAL DAMAGES, REGARDLESS OF THE THEORY OF LIABILITY. ORDERDASH'S AGGREGATE CUMULATIVE LIABILITY TO THE RESTAURANT FOR ALL CLAIMS SHALL BE STRICTLY LIMITED TO THE LESSER OF: (A) ONE HUNDRED US DOLLARS ($100 USD), OR (B) THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY THE RESTAURANT TO ORDERDASH IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

§ 12 Dispute Resolution & Governing Law

This Agreement shall be governed by, and construed in accordance with, the laws of India. Any disputes arising out of this Agreement that cannot be resolved amicably shall be settled through binding arbitration under the Indian Arbitration and Conciliation Act, 1996. The seat of arbitration shall be the city of OrderDash's primary headquarters. The proceedings shall be conducted in English, and both parties submit to the exclusive jurisdiction of the local courts of the registered office city.

§ 01 Introduction & Agreement

Welcome to OrderDash. OrderDash is a technology platform that enables customers ("Users", "Guests", "you", or "your") to browse digital menus, place dine-in/ordering requests, and make payments with participating restaurants, cafes, bars, and food venues (each, a "Restaurant"). By scanning an OrderDash table QR code, checking in, placing an order, or making a payment through our web interface, you agree to comply with and be bound by these Terms & Conditions. If you do not agree to these terms, you must not use the Platform.

§ 02 Technology Platform Intermediary Role

OrderDash acts strictly as a technology platform facilitating ordering and payment collection on behalf of participating restaurants. OrderDash acts solely as a technology intermediary connecting customers and Restaurants. OrderDash does not prepare, cook, package, store, handle, or deliver food items. All culinary operations, ingredients, food preparation, preparation time, table service, and physical establishment operations are managed entirely by the independent participating Restaurant.

§ 03 User Eligibility

To use this Platform, you must be at least eighteen (18) years of age or access the Platform under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms. By placing an order, you represent that you possess the legal authority to enter into financial transactions.

§ 04 Account & Contact Information

When placing orders or registering customer details (such as your name for table check-ins or your email address for digital invoices), you agree to provide accurate, current, and complete information. You are responsible for any errors or failures resulting from inaccurate contact details.

§ 05 Ordering, Acceptance & Finality

All orders placed through the Platform are sent to the Restaurant's kitchen console for preparation. Once confirmed by the Restaurant, orders become final, binding, and cannot be cancelled or modified by the customer. The Restaurant is solely responsible for accepting or rejecting orders, managing item availability, and preparing food. OrderDash does not guarantee order completion times or Restaurant acceptance.

§ 06 Menu Pricing & Invoicing

Food preparation, quality, pricing, and tax compliance remain the sole responsibility of the Restaurant. Menu prices are determined entirely by the Restaurant and may change without notice. The Restaurant is solely responsible for adding correct taxes (such as GST or service charge) and complying with local tax invoicing rules. OrderDash is not liable for wrong pricing, hidden charges, or tax calculation issues on your bill.

§ 07 Payments & Third-Party Processors

All digital payments made through the Platform are processed by secure, integrated third-party payment gateways (e.g. Razorpay, UPI networks). OrderDash does not handle, clear, store, or hold your credit/debit card numbers or bank account credentials. All transactions are settled directly into the Restaurant's bank account. Any payment failures, transaction drops, double debits, or billing disputes are subject to the terms of the third-party payment processor and the Restaurant.

§ 08 Food Safety & Restaurant Responsibility

Food quality, ingredients, preparation standards, hygiene, health compliance, and adherence to food safety laws (including FSSAI standards) are the sole and exclusive responsibility of the Restaurant. OrderDash disclaims all responsibility for the safety, taste, freshness, contamination, or quality of food served at the establishment. Any food safety complaints or claims must be directed to the Restaurant.

§ 09 Severe Food Allergy Warning

Customers with food allergies or severe dietary restrictions must verify all ingredients directly with the Restaurant staff before placing an order. OrderDash lists menu descriptors as provided by the Restaurant and cannot guarantee that dishes are free from cross-contamination, nuts, gluten, dairy, or other allergens. OrderDash is not responsible for any allergic reactions or health incidents.

§ 10 Prohibited Platform Use

You agree not to engage in any prohibited activities, including but not limited to: (i) attempting to hack, disrupt, or damage the Platform's servers or networks; (ii) creating fake table check-ins, placing spam orders, or committing billing fraud; (iii) harassing, abusing, or threatening Restaurant employees or OrderDash staff; or (iv) using bots, scrapers, or automated tools to access menu data.

§ 11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDERDASH, ITS AFFILIATES, AND OFFICERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR USE OF THE PLATFORM; (II) FOOD-RELATED ILLNESSES, INJURIES, OR DISPUTES AT THE RESTAURANT; (III) SYSTEM DOWNTIME OR PAYMENT FAILURE EVENTS; OR (IV) DELETION OR BREACH OF GUEST DATA. ORDERDASH'S AGGREGATE LIABILITY FOR ALL CLAIMS IS CAPPED AT A MAXIMUM OF ONE HUNDRED US DOLLARS ($100 USD).

§ 12 Intellectual Property

All software code, brand designs, logos, custom vector icons, website layouts, database structures, and platform assets are the exclusive intellectual property of OrderDash. You may not copy, reverse-engineer, modify, or redistribute any aspect of the Platform without our prior written consent.

§ 13 Service Suspension

OrderDash reserves the right, in its sole discretion, to suspend, terminate, or block your access to the Platform (including table check-ins and order placement) if we detect fraudulent activity, spam orders, billing evasion, terms violations, or system abuse.

§ 14 Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the primary city of OrderDash's headquarters, subject to binding arbitration as outlined in our partner agreements.
